Terms of Service

Boourac is an international marketplace platform that connects sellers and buyers from various countries to conduct cross-border trade transactions. We provide the infrastructure and tools to facilitate commerce but are not directly involved in transactions between users.

To use Boourac, you must:

• Be at least 18 years old or have legal authorization to enter into binding contracts
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Accept full responsibility for all activities under your account

Registration:

• You must create an account to use certain features
• Sellers must provide valid and verifiable identification
• Business sellers must provide appropriate business documentation

Account Security:

• You are responsible for maintaining account confidentiality
• Notify us immediately of unauthorized access
• We reserve the right to suspend or terminate accounts for security reasons

As a seller, you agree to:

• Provide accurate and transparent product information
• Ensure products comply with international and destination country laws
• Meet international packaging and shipping standards
• Obtain necessary certifications (FDA, CE, BPOM, MSDS) for applicable products
• Process orders within stated timeframes
• Honor advertised prices and product descriptions
• Respond promptly to buyer inquiries

As a buyer, you agree to:

• Provide accurate shipping information
• Comply with destination country import regulations
• Pay applicable customs duties and taxes (unless DDP)
• Complete payment within specified timeframes
• Provide honest feedback and reviews

Prohibited Items:

• Illegal or counterfeit goods
• Weapons, narcotics, and hazardous materials
• Products infringing intellectual property rights
• Items violating destination country regulations
• Products without required certifications

Prohibited Activities:

• Fraud and transaction manipulation
• Creating fake reviews or ratings
• Payment system abuse
• Harassment or abusive behavior
• Any activities violating international law

• Sellers set their base price (the amount they wish to receive)
• Marketplace applies a flat 20% markup on all products
• Final price to customers = Base Price + 20% markup
• Sellers receive their full base price upon successful transaction
• All payments must be made through marketplace payment systems
• We may hold funds temporarily (escrow) until transaction completion
• Currency conversion follows applicable exchange rates at transaction time
• All fees are non-refundable unless otherwise stated

• Shipping conducted through official marketplace logistics partners
• Delivery timeframes are estimates and not guarantees
• Sellers are responsible for accurate product packaging
• Customs processing delays are not marketplace responsibility
• Risk of loss transfers to buyer upon delivery

• Import duties and taxes are determined by destination country authorities
• Buyers are responsible for customs fees unless DDP shipping selected
• Marketplace does not set or collect customs duties
• Tariff rates depend on HS Code, product value, and country of origin
• We are not responsible for customs rejections or delays

• Returns must comply with seller and marketplace policies
• Buyers must provide valid evidence for dispute claims
• Marketplace reserves the right to mediate and make final decisions
• Refunds processed according to original payment method
• Return shipping costs may be buyer's responsibility

• Sellers must own or have rights to all listed content and products
• Products infringing trademarks, patents, or copyrights are prohibited
• We may remove suspected infringing content without notice
• Marketplace retains rights to platform content and branding
• Users grant us license to display their content on the platform

We reserve the right to:

• Suspend or close accounts violating these terms
• Remove content without prior notice
• Permanently deny service access
• Take legal action for serious violations
• Withhold payments for policy violations

Marketplace is not responsible for:

• Quality, safety, or legality of products listed
• Accuracy of listings or seller representations
• Buyer-seller disputes or transaction failures
• Indirect, incidental, or consequential damages
• Shipping errors by third-party carriers
• Customs rejections or delays
• Legal violations by users
• Force majeure events

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

You agree to indemnify and hold harmless Boourac, its affiliates, and personnel from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these terms
• Your products or services
• Infringement of intellectual property rights
• Violation of applicable laws

We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of modified terms. We will notify users of significant changes via email or platform notification.

These terms are governed by applicable law in the jurisdiction determined by the marketplace. Any disputes shall be resolved through:

• Good faith negotiation between parties
• Mediation if negotiation fails
• Binding arbitration as final resort
